By using Broker Gully, you consent to the data practices described in this policy.
2. Information We Collect
A. Broker Personal Information
To create and verify your account, we collect:
- Identity Data: Name, Phone Number, Email Address.
- Business Data: Firm Name, Office Address, RERA Registration Number, GST Number.
- KYC Documents: Digital copies of PAN Card, Aadhar Card, and Business Licenses.
B. Lead & Client Data (The "Marketplace Data")
When you upload a lead or client requirement:
- Input Data: Client Name, Budget, Location Preferences, and Contact Number.
- Usage: This data is stored securely in your private CRM. It is never visible to other brokers unless you explicitly initiate a "Lead Transfer."
C. Device & Location Information
- Geolocation: Used to verify your operational region (e.g., matching you to the "Agra North" zone).
- Device IDs: Used for security and sending Push Notifications.
3. How We Use Your Data
We use the collected data for the following specific business purposes:
- Identity Verification: To validate your status as a professional broker via our KYC process.
- Lead Matching: To recommend your profile to other brokers looking for partners in your specific region.
- Dispute Resolution: To investigate reports of misconduct in lead transfers.
- Platform Security: To detect and ban spammers or fake accounts.
4. Sharing of Information (The "Handshake" Protocol)
Broker Gully operates on a specific "Consent-Based Sharing" model regarding Client Data:
A. Lead Transfer Marketplace
- Locked State: When you post a lead to the marketplace, other brokers see only the Requirement (e.g., "3BHK, Budget 50L"). Client Name and Phone Number are hidden.
- Unlocked State: Client contact details are shared with a receiving broker only after they click the "Accept" button.
- Liability: Once a lead is accepted, the receiving broker becomes an independent data controller of that client's information. Broker Gully is not liable for the receiving broker's offline conduct.
B. Legal Requirements
We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or government agency).
5. Data Security & Retention
- Encryption: All sensitive data (KYC documents, Passwords) is encrypted at rest and in transit using industry-standard SSL protocols.
- Access Control: Your KYC documents are accessible only by authorized Compliance Staff.
- Retention: We retain your account data as long as your account is active. If you delete your account, we may retain transaction logs for audit purposes as required by Indian law.
6. Chat Monitoring Policy
To ensure a professional trading environment, Broker Gully reserves the right to monitor "Broker-to-Broker" chats only under the following conditions:
- Dispute Investigation: If a transaction is flagged or reported by a user.
- Fraud Detection: Automated scanning for spam patterns or abusive language.
We do not read private chats for marketing purposes.
7. Your Rights
- Access & Correction: You may edit your profile and business details at any time via the App Settings.
- Data Portability: You may request an export of your Lead History and Transaction Logs.
- Account Deletion: You may request permanent deletion of your account by contacting support. Note that active leads must be closed or transferred before deletion.
